Representative Achievements and Current Litigation

Mansfield, Tanick & Cohen is currently defending a subsidiary of a major national drugstore chain that provides pharmacy benefit services to other major chains and independent pharmacies across the country. In this case, brought in federal court in Minnesota as a nationwide class action, plaintiffs have alleged that the defendant incorrectly applied its reimbursement formula, resulting in overcharges for processing services by which pharmacies obtain payment from health insurers and other third-party payors. The case is in the discovery phase and is being vigorously defended by the Firm and co-counsel. Robin Drug Co. v. PharmaCare Management Services, No. 03-CIV-3397 (PAM/RLE)(D.Minn.).

• In 2005, Mansfield, Tanick & Cohen achieved a substantial arbitration award on behalf of a Minnesota-based seed food plot distributor in a breach of contract case, while successfully defending against various counterclaims.
• In 2004, Mansfield, Tanick & Cohen successfully defended a major manufacturer and distributor of industrial motion detection sensors in parallel federal and state court lawsuits involving a former distributor who had sought millions of dollars in damages.
• In 2004, Mansfield, Tanick & Cohen successfully represented a Minnesota-based metalworking company in a lawsuit against national and local telephone service providers seeking damages based upon faulty installation of a communications network. Prior to trial, the Firm obtained a six-figure settlement for the plaintiff.
• In 2004, Mansfield, Tanick & Cohen obtained a six-figure settlement on behalf of a group of former massage school students against a for-profit cosmetology school, following the filing of a lawsuit seeking damages for sexual abuse, breach of contract and false representations concerning the quality and content of the curriculum.
• In 2002, Mansfield, Tanick & Cohen successfully obtained a seven-figure resolution in an arbitration by a minority shareholder against a well-known, closely held Twin Cities business.
• In 2002, Mansfield, Tanick & Cohen successfully obtained a seven-figure payment in a lawsuit by a minority shareholder against twenty-two related business entities and a dozen individual defendants who were represented by three different law firms.
• In 2001, Mansfield, Tanick & Cohen litigated and settled a federal lawsuit involving the purchase of millions of dollars of assets of a New Jersey-based company and its Texas subsidiary by a Minnesota-based company.
• In 1999, Mansfield, Tanick & Cohen recovered hundreds of thousands of dollars in damages for a California-based restaurant in a trademark and trade-dress dispute in which the Firm's client was originally the defendant.
• Mansfield, Tanick & Cohen has recently represented companies in dozens of commercial disputes involving multiple plaintiffs and defendants in state and federal court, including large computer contract disputes, distributor litigation, patent disputes, and trade secrets cases, among others.
• Mansfield, Tanick & Cohen has been retained by a Fortune 100 national drug store chain to prosecute its claims arising out of an international vitamin price-fixing scheme.
