  • Charles A. Horowitz and Brian N. Niemczyk recently prevailed at the summary disposition stage in connection with a veteran's preference hearing related to a fire department's attempt to terminate a firefighter because of his claimed medical problems. Mansfield Tanick & Cohen was able to convince the commission hearing the case to summarily reverse the department's termination decision prior to the hearing even being held, based upon the fact that the department had tried, and failed, to terminate the same firefighter for the same alleged medical condition in the past. The Firm's victory in this matter prior to the evidentiary hearing saved the client thousands of dollars in legal and expert fees and won him full reinstatement to his job.
